שאלה:

I am teaching an Introduction to Jewish Law at the University of North Carolina in Greensboro. In teaching Mishnah Yoma Chapter 8, particularly Mishnah 7, I want to explain the Halakhah about saving life of a non-Jew when that would entail violating the sabbath/holiday prohibition on work. What is the current view, i.e. the "halakhah pesuqah" on this question?

Does the law passed by the Knesset in 1998: "Lo'Ta'amod al Dam Re'ekha" apply to Jews and non-Jews alike? If an observant Jew were to not render assistance to a non-Jew as required by this law, would traditional halakhah provide a legitimate defense in Israel? Is there any subsequent litigation or legislation on this issue? Or any recent Shelot ve-Tshuvot on this specific quesiton? I do have the Bar Ilan Responsa CD version 12+. Any additional bibliography on this subject [in Hebrew or English], especially in English that I could give to my students here — most of whom are Christians and do not read Hebrew — would be very much appreciated. I have just printed out from the internet Mordechai Halperin's article "Lo Ta'amod al Dam Re'ekha" published in Assia 1999. I also have the article by Dr. Eliezer Ben-Shelomo "Ha-Hovah le-Hatzil Nefashot" published in Assia 1994 and the entry on Hatzalat Nefashot from the Encyclopedia Talmudit.

a.  the law passed by the Knesset in 1998: "Lo'Ta'amod al Dam Re'ekha" applies to Jews and non-Jews alike

b.   According to the strict ruleing of the great Poskim of our generation, a physician should treat and save a jew and a jentile without discrimination.
